Terms & Conditions – Herzog Medical B.V.
1 General
1.1 These Terms & Conditions apply to all agreements related to online orders between Herzog Medical B.V. and the customer.
1.2 The website of Herzog Medical B.V. is regularly updated and/or modified. Herzog Medical reserves the right to make changes immediately and without prior notice.
1.3 By placing an order, every customer unconditionally agrees to these Terms & Conditions.

3 Offer and Prices
3.1 Prices listed with the products are in euros and include VAT. Shipping costs are not included.
3.2 The offer contains a complete and accurate description of the products offered. Images are a true representation of the products, as far as possible.
3.3 Herzog Medical B.V. is not liable for the consequences of printing, typographical, or programming errors on its website. No rights can be derived from incorrect price information.
3.4 The limited validity period and conditions of special offers, deviating from the standard assortment, are explicitly stated.
3.5 Offers from Herzog Medical B.V. do not automatically apply to repeat orders.
3.6 Herzog Medical B.V. is not bound by an offer if the customer should have reasonably understood that it contained an obvious mistake or error.
3.7 Additions, amendments, and verbal commitments are only valid if agreed upon in writing.
We only supply B2C consumers through our webshop. For business purchases with reverse-charging VAT, please contact us at 0342-745 041. Creating reverse-charging VAT invoices retroactively is not possible.
4 The Agreement
4.1 An agreement between Herzog Medical B.V. and the customer is concluded after the feasibility of the order has been assessed.
4.2 If the customer accepts the offer electronically, Herzog Medical B.V. will confirm receipt of acceptance without delay. As long as this confirmation has not been received, the customer may cancel the contract.
4.3 Herzog Medical B.V. takes appropriate technical and organisational measures to secure the electronic transfer of data and ensures a safe web environment.
4.4 Within legal boundaries, Herzog Medical B.V. may assess whether the customer can meet their payment obligations and other relevant factors for responsibly entering into the contract. If there are valid reasons not to proceed, Herzog Medical B.V. may refuse the order or attach special conditions.
4.5 Herzog Medical B.V. will provide the customer, together with the product, with the following information in writing or in a durable, accessible form:
a) contact details for complaints,
b) the conditions and manner of exercising the right of withdrawal, or a clear statement if excluded,
c) warranty information.
5 Payment
5.1 Payment is made using the payment methods offered on the website.
5.2 Orders must be paid for in advance. Products will only be shipped once payment is received.
6 Shipping Costs
6.1 Shipping costs depend on the delivery destination and are clearly displayed in the webshop.
6.2 For orders over €40, shipping is free within the Netherlands and Belgium.
7 Delivery
7.1 Deliveries are handled by recognised postal/courier companies.
7.2 Herzog Medical B.V. aims to dispatch orders within 1 business day after receiving payment.
7.3 The statutory delivery period is 30 days. If the customer has not received the order within this period, the purchase may be cancelled free of charge.
7.4 If a product is out of stock, the customer will be informed as soon as possible and may cancel the order free of charge. Herzog Medical will then arrange a refund.
7.5 Herzog Medical B.V. is not liable for damage resulting from an incorrect delivery address provided by the customer.
7.6 The risk of damage or loss lies with Herzog Medical B.V. until delivery to the customer or a designated representative, unless otherwise agreed.
8 Cancelling/Changing Orders
8.1 An order may be cancelled before 1:00 PM on the day it was placed, provided it has not yet been shipped. Cancellation must be made by phone or email.
8.2 Orders may be changed or additional items added before 1:00 PM on the day of order placement, provided the order has not yet been shipped.
9 Exchange and Returns
9.1 After delivery, the customer has 14 days to exchange or return items. After this period, the purchase is final.
9.2 During the cooling-off period, the customer must handle the product and packaging carefully. The product may only be unpacked as necessary to determine whether it should be kept.
9.3 To exercise the right of withdrawal, the customer must follow the instructions provided upon delivery.
9.4 Conditions for returns/exchanges:
a) Notify customer service (info@herzogmedical.com) before returning or reporting a defect.
b) Goods must be returned unworn, in original condition, and in original packaging. Outlet items cannot be returned.
c) Return shipping costs are borne by the customer. Unpaid or insufficiently paid returns will not be accepted.
9.5 These rules apply only to items purchased via HerzogMedical.com. Purchases from retail partners must be returned/exchanged directly at the respective store, in accordance with their policies.
10 Costs for Returns
10.1 Return shipping costs and risks are borne by the customer.
10.2 Refunds (excluding shipping costs) will be processed within 30 days after the returned products are received in good condition.

11 Warranty and Complaints
11.1 Herzog Medical B.V. guarantees that the delivered products meet the usual standards of usability, reliability, and durability.
11.2 The customer must check the goods immediately upon receipt. Incorrect or incomplete deliveries must be reported to info@herzogmedical.com before returning the items. Products must be returned in their original packaging and in new condition.
11.3 Use, resale, or damage after discovery of a defect excludes complaints.
11.4 A purchase receipt serves as proof of warranty.
11.5 Complaint procedure:
a) Complaints must be submitted by email with order number, description, and photos if applicable.
b) Complaints will be processed within 30 days.
11.6 If a complaint is valid, compensation will be limited to the invoice amount of the relevant product(s).
11.7 In case of replacement, the returned product becomes property of Herzog Medical B.V.
11.8 Warranty does not apply if defects are due to:
a) improper use,
b) ignoring instructions,
c) ignoring washing instructions,
d) alterations or repairs by third parties,
e) abnormal conditions or careless handling,
f) expired product lifespan.
11.9 For purchases from retail partners, warranty and complaints must be handled through the respective point of sale.
12 Privacy
Your personal data is stored in Herzog Medical B.V.’s customer database and used for order processing, customer management, risk management, and marketing purposes. Data will not be shared with third parties that affect your privacy. If you no longer wish to receive marketing communications, you can notify us by email.
13 Copyright
It is not permitted, without written consent, to copy, store, publish, reproduce, or otherwise use any text and/or images. Legal action will be taken in case of violation.
